1. 
Definitions 
 
1.1 
Words defined in the 
Terrorism (Extraordinary Powers) Act 2005
(the 
Act) and used in this Practice Direction have the same respective 
meanings as in the Act. All references to sections in this Practice 
Direction are references to sections in the Act. 
1.2. 
'Court Officer' means such member or members of the Court Registry 
staff as the Principal Registrar may from time to time in writing 
nominate. Until a written nomination is made the Court Officer is: 
(a)
during Court Registry business hours, the Trials Coordinator 
or, in his/her absence, the Listings Coordinator or Manager 
Listings; or
(b)
outside of Court Registry business hours, the Associate to the 
duty Judge.

Introduction 
 
2.1 
This Practice Direction applies to the following applications made 
under: 
(a)
s 7(3) and (4) for approval for the Commissioner to issue a 
warrant;
(b)
s 24 (read with s 25 and s 26), for a covert search warrant; and 
(c) s 29 for publication of confidential information in relation to a 
covert search warrant.
2.2 
This Practice Direction also applies to reports required to be filed by 
the authorised applicant under s 28. 
2.3 
The object of this Practice Direction is to regulate the procedure for 
making applications under these sections.

Proceedings under the Act are not to be held in public.
2.5
Information about any proceeding under the Act is not to be 
publicised in any public list of the business of the Supreme Court, 
unless in accordance with approval of the Court (s 29(2)). An 
application for the Court's approval to publish any information about 
a proceeding must be in accordance with paragraph 7 of this Practice 
Direction. 
2.6
Court administrative and personal staff and departmental staff and 
contractors must not disclose to another person: 
(a)
the existence of, or any detail of, a covert search warrant; 
(b)
the existence of, or any information about, any proceedings in 
relation to a warrant; or 
(c)
the existence of, or any detail of, any report or interim report 
given under s 28,
unless in accordance with approval of the Court (s 29(2)). An 
application for the Court's approval must be in accordance with 
paragraph 7 of this Practice Direction. 
2.7 
In view of the nature of the applications, they will be processed 
promptly and with complete confidentiality, and any information 
about those proceedings will be confined within the narrowest 
possible limits.
