Introduction
Henry Fielding was a playwright and writer until his theatrical career was cut short by the Licensing Act of 1737. Many of Fielding's early writings contain legal references, although the majority were "incorrect." 2 Entered the Middle Temple in November 1737, and Fielding was summoned to court on June 20, 1740. Fielding continued to write as a lawyer to supplement his income. Tom Jones, the comic who established Fielding as "the founder of the English novel," did not publish until February 1749, after Fielding had abandoned Barney on the bench. This course work investigates how Fielding's direct and comparable depiction of the law in Tom Jones reflects his legal education and professional experience as a lawyer and judge.
This course material is reviewed three times. To begin, Tom Jones' format is similar to that of a court case. The narrator and the perfectly matched opposing characters present the reader with contradictory "evidence," from which he is supposed to make a succession of "judgments" before arriving at a final decision. Second, Fielding assigns the pupil the job of judge or referee. And no court or judge may reach a legal conclusion or judgment until all information is considered in context. Third, this course work stresses the clear link between Tom Jones' content and organization and Fielding's practical expertise in the legal area.
Fielding's life is shown in ways that match Tom Jones' autobiography. Part III includes a synopsis of Tom Jones's connection with modern reviewers. Part IV examines how Fielding used language to make law the fundamental focus of Tom Jones. In addition to highlighting major legal parallels, this section delves into Squire Western's use of the hunting theme metaphor, particularly Fielding's, which dominates its connections to Tom and Sophia's relationship. This part includes Squire Allworthy's current analysis in Part V, as well as a comparison of his point of view to Western solutions. Section IV closes with a discussion of the student's active involvement as a judge
Fielding occurs when a student gives facts to back up their opinion or judgment. It has parts on conditional arguments, character arguments, and evidence manipulation, and it finishes by highlighting Squire Allworthy's ability to evaluate character. Part VI is a detailed examination of Counsel Dowling. An examination that connects the topic of Dowling and his behavior to the specifics of eighteenth-century barrister training, position, and public opinion reveals that Fielding's practical and personal experiences are congruent with Tom Jones' core legal difficulties. The debate of Dowling's character, in addition to demonstrating Fielding's loathing of "lawyers and trifles," shows how Fielding's case is proceeding, with Tom Jones covering up the entire truth until the conclusion. while delivering warning advice to the observant reader
Blifil and Tom Jones integrate the discussion and analysis offered in previous parts with particular allusions by using the "little narrative" of "little Tommy," itself a metaphor for Tom Jones in general. After evaluating the available evidence at the time against Blifil and Tom, as well as against himself, the distinction between deed and perpetrator is examined and related to the metaphor of the hunt under consideration.
