Real property law
Full ownership of (1) ___________ is called “fee simple", "fee simple absolute” or sometimes just (2) ___________. Among other important rights included in fee simple ownership are the right to:
use the real property at its discretion; take rented products, or profits the property; to pledge through a mortgage the property; limit the use of the property; allow others to use the property; and sell the property.
The fee simple owner must: pay taxes on the land; comply with zoning requirements and other restrictions on the use of the land; honor the rights of others who own shares in the land (co-owners, tenants, mortgagees, easement holders, etc.). Further, the fee simple owner must use the land in such a way that the use does not interfere with the rights of other landowners and the public.
It is possible for a fee simple owner transfer ownership of his/her property to another person for the term of that other person's life. This type of ownership is called life estate. The person who holds the life estate is called lifelong owner. With certain important exceptions, a life tenant can use the property in much the same way a fee simple owner can use her property.
The life tenant cannot decide how the property will be distributed upon the life tenant's death. The life tenant cannot sell absolute share of property in real estate. When a life estate is created, the property right is also created. The person who holds the remainder interest (the remainderman) automatically gets fee simple title to the property when the life tenant dies.
