NOTICE OF CONFIRMATION OF ROAD
PROCESS ORDER


Road Closure—St Kilda Road, St Kilda

BY Road Process Order made on 30 June 2011, the City of Salisbury ordered that:

1. An irregularly shaped portion of St Kilda Road situate adjoining Fooks Terrace, Allotment 49, Town of St Kilda and Allotment 501 in Deposited Plan 68610 more particularly delineated and lettered ‘A’ and ‘B’ (respectively) on Preliminary Plan No. 09/0003 be closed.

2. Transfer the whole of the land subject to closure to Dominic Paul Calabria and Frances Mary Calabria in accordance with the agreement for transfer dated 30 June 2011 entered into between the City of Salisbury and D. P. and F. M. Calabria.

3. The following easements are granted over portions of the land subject to that closure:

Grant to the Distribution Lessor Corporation an easement for overhead electricity supply purposes.

Grant to the South Australian Water Corporation an easement for water supply purposes.

On 31 January 2012 that order was confirmed by the Minister for Transport and Infrastructure conditionally upon the deposit by the Registrar-General of Deposited Plan 87415 being the authority for the new boundaries

Pursuant to Section 24 (5) of the Roads (Opening and Closing) Act 1991, NOTICE of the order referred to above and its confirmation is hereby given.

ROADS (OPENING AND CLOSING) ACT 1991:
SECTION 34

ORDER BY THE MINISTER TO CLOSE ROAD

Dawson Road, Evanston Gardens

BY an Order made on 3 November 2011 under Sections 6 and 34 of the Roads (Opening and Closing) Act 1991, the Minister for Transport and Infrastructure ordered that the whole of Dawson Road situate between Northside Court and Gordon Road and adjoining the western boundaries of Allotments 19, 22, 23, 26, 27, 30, 31 and 34 in Deposited Plan 3334 be closed.

Vest in the Crown the whole of the land subject to closure.

On 3 November 2011 that order was confirmed by the Minister for Transport and Infrastructure conditionally upon the deposit by the Registrar-General of Deposited Plan 88211 being the authority for the new boundaries.

Notice of the Order is hereby published in accordance with Section 34 (7) of the said Act.

ROAD TRAFFIC ACT 1961

NOTICE OF APPROVAL AND EXEMPTION

Pursuant to Sections 161A and 163AA of the Road Traffic Act 1961

OPERATION OF OPAL MINING VEHICLES

1. Approval

1.1 Pursuant to Section 161A of the Road Traffic Act 1961 and Regulation 35 of the Road Traffic (Miscellaneous) Regulations 1999, I hereby approve opal mining vehicles which exceed 4.3 m in height and 2.5 m in width, to operate on South Australian roads.



2. EXEMPTION

2.1 In accordance with the powers delegated to me by the Minister for Transport, under Section 163AA of the Road Traffic Act 1961, I hereby exempt vehicles used solely for the purpose of mining opal from the following provisions of the:



Road Traffic (Vehicle Standards) Rules 1999

 Part 8—Lights and reflectors;

 Rule 19—Compliance with second edition Australian Design Rules;

 Rule 20—Compliance with third edition Australian Design Rules;

 Rule 28—Turning ability;

 Rule 30—Protrusions;

 Rule 33—Mudguards and spray suppression;

 Rule 38—Automatic transmissions;

 Rule 45—Windscreen wipers and washers;

 Rule 66—Width;

 Rule 72—Height;

 Rule 146—Crank case gases;

 Rule 147—Visible emissions;

 Rule 148—Exhaust systems; and



Road Traffic (Miscellaneous) Regulations 1999

 Regulation 25—Modification to motor vehicles;

 Regulation 26—Wheels and tyres;

 Regulation 36—Seat belts and seat belt anchorages;

 Regulation 37—Child restraints; and

Road Traffic Act 1961

 Section 110B—Motor vehicle or trailer shall bear a vehicle identification plate.

2.2 This exemption is subject to the conditions and limitations specified in this Notice.

3. CONDITIONS AND LIMITATIONS APPLYING TO THIS NOTICE

3.1 Special Conditions

3.1.1 When operating under this Notice, you must carry a legible, current and complete copy of this Notice either in hardcopy or in an electronic format so that it can be read from a device having a visual display (e.g. smart phone, tablet or laptop PC, in vehicle unit) that is carried within the vehicle and that is accessible, to a DPTI Authorised Officer appointed under the Road Traffic Act 1961, or a Police Officer, from outside the vehicle.

3.2.2 Except as otherwise specified in this Notice the Standard Form Conditions prescribed in the Road Traffic (Oversize or Overmass Vehicle Exemptions) Regulations 1999, for the purposes of Section 115 (3) of the Road Traffic Act 1961, shall not apply.

3.3.3 This notice shall stand alone. It cannot be used in conjunction with any other exemption, notice or permit.

3.2 Vehicle Description

3.2.1 This notice only applies to vehicles or machines commonly known as blowers, noodling machines, elevators and prospecting drills.

3.3 Area of Operation

3.3.1 Travel is permitted on roads, other than those maintained by the Commissioner of Highways (although such roads may be crossed) that are within a 150 km radius of Coober Pedy, provided that the lights and reflectors as specified in Clause 3.12 of this Notice are met.

3.3.2 Travel is permitted on roads within a 150 km radius of Coober Pedy and a 150 km radius of Marla including roads maintained by the Commissioner of Highways, provided that the vehicle is fitted with all lights, reflectors and rear marking plates required by Part 8—Lights and Reflectors, of the Road Traffic (Vehicle Standards) Rules 1999.

3.4 Dimensions

3.4.1 The overall width of the vehicle shall not exceed 4 m.

3.4.2 If the vehicle exceeds 5.7 m in height, written approval of the District Council of Coober Pedy is required to determine escort requirements prior to travelling within the local government area of Coober Pedy.

3.5 Times of Travel

3.5.1 Travel is not permitted between the hours of sunset and sunrise as specified in the Proof of Sunrise and Sunset Act 1923, as amended, and published in the South Australian Government Gazette or during periods of low visibility.

Note: For the purpose of this notice ‘a period of low visibility’ means any time when, owing to insufficient daylight or unfavourable conditions, persons or vehicles on a road are not clearly visible at a distance of 250 m to a person of normal vision.

3.6 Warning Signs

3.6.1 When travelling along the Stuart Highway or within the Coober Pedy Township, a warning sign complying with the requirements of Clause 3.7 and 3.8 of this Notice shall be affixed to the front and rear of the vehicle.

3.7 Warning Sign Specifications

3.7.1 Face of warning sign

The warning sign shall comply with the following specifications:

OVERSIZE VEHICLE WARNING SIGN

3.7.1.1 The face of the warning sign shall have a yellow surface which complies with Class 1 or 2 of Australian/New Zealand Standard AS/NZS 1906.1, ‘Retro-reflective Materials and Devices for Road Traffic Control Purposes’ Part 1: Retro-reflective Sheeting.

3.7.1.2 The face of the warning sign shall show the words ‘OVERSIZE’ in black upper-case lettering at least 200 mm high, conforming with Australian Standard AS 1744, ‘Forms of Letters and Numerals for Road Signs’, in type face Series C(N).

3.7.1.3 The face of the warning sign must have a black border at least 20 mm wide.

3.7.1.4 The outermost edge of the border of the warning sign must be set at least 10 mm in from the edge of the sign unless the sign has been made with a box edge.

3.8 Material for Warning Signs

3.8.1 A warning sign must be made of stiff, flat, weatherproof material, for example zincalume at least 0.8 mm thick or aluminium at least 1.6 mm thick.

3.8.2 In spite of Clause 3.8.1. a warning sign may be made of a flexible material provided that it complies with all other requirements as if it were a stiff sign and it is mounted in accordance with Clause 3.9.3.

3.9 Mounting of Warning Signs

3.9.1 The warning sign must be mounted in an up right position.

3.9.2 The lower edge of the warning sign shall be:

3.9.2.1 Above the bottom of the bumper bar; or

3.9.2.2 If there is no bumper bar fitted at least 500 mm from ground level.

3.9.2.3 If the warning sign is split into two parts each part shall be fitted at the same height to each other.

3.9.3 If a flexible warning sign is fitted it shall be:

3.9.3.1 Held taut and be clearly visible; and

3.9.3.2 Unlikely to become dislocated, furl or otherwise become difficult to read by other road users.

  3.10 Flags

3.10.1 Brightly coloured red, yellow, or red and yellow flags, at least 450 mm long and at least 450 mm wide shall be attached to the extremities of the vehicle which shall:

3.10.2 Be positioned with one of the flags on each side of the front and rear of any projecting load or if there is no projecting load the flags shall be positioned at the vehicle or vehicle combination extremities; and

3.10.3 Be clearly visible at a distance of 100 m to any person with normal vision.

  3.11 General Conditions

3.11.1 The person driving the vehicle or combination shall, at regular intervals, when it is practicable to do so and there is not a separate lane available for overtaking, move off the carriageway to allow other vehicles to overtake.

3.11.2 The driver shall avoid all overhead obstructions.

3.11.3 Travel is not permitted on wet roads.

3.11.4 Travel is not permitted in the rain.

3.11.5 This Notice shall operate only with respect to the vehicles, loads, routes and times specified and does not relieve the owner and/or driver of the duty to observe all other provisions of the Road Traffic Act and Regulations and Local Government by-laws.

  3.12 Lights and Reflectors

3.12.1 The vehicle is fitted with rear direction indicator lights, brake lights, parking lights and rear reflector(s).

3.12.2 Motor vehicles with a Gross Vehicle Mass over 12 tonnes and trailers with a Gross Trailer Mass over 10 tonnes shall be fitted with rear marking plates.

3.12.3 All lights, reflectors and rear marking plates required by this notice shall meet the location and performance requirements of Part 8—Lights and Reflectors, of the Road Traffic (Vehicle Standards) Rules 1999.

Note: Persons operating under the provisions of this Notice are advised that some parts of the road system bridges, signs, roadside furniture and vegetation may not provide sufficient clearance for the passage of a vehicle and load at the dimensions permitted by this notice.

Note: Section 107 of the Road Traffic Act 1961 (Damage to road infrastructure) requires you to immediately notify a police officer or road authority, if you cause damage to roads, bridges and culverts, or if you interfere with roadside furniture.

4. COMMENCEMENT OF THIS NOTICE

4.1 This Notice is valid from 12.01 a.m. on 17 February 2012 until midnight 31 December 2014.

1.2 The Lotteries (Monday and Wednesday X Lotto) Rules made under the State Lotteries Act 1966 and published in the Government Gazette on 20 May 2010 are hereinafter referred to as the ‘Principal Rules’.
1.3 The Principal Rules are hereby amended effective from 23 February 2012 and these Rules will take effect immediately thereafter, except as provided in these Rules.

The Principal Rules are deleted and the Rules as annexed are to be substituted therefor.
